Central Information Commission
Block No IV, (5th Floor)
Old JNU Campus, New Delhi-67
Dated 18/1/’06
An appeal was received from Shri Mahadev Ramrao Sabnis, A-5, Zapurza, Dr. S.R. Road, Andheri, Mumbai dated 31/12/2005 against the Central Public Information Officer (CPIO), Central Registrar Cooperative Societies, Department of Agricultural and Cooperation, Ministry of Agriculture, Government of India, New Delhi indicating that the said CPIO did not furnish information sought by the appellant vide his application under the Right to Information (RTI) Act, 2005, dated 21/10/2005.
From the list of documents submitted by the appellant to the Commission it appears that he has not preferred an appeal with the first Appellate Authority i.e. an officer senior in rank to the CPIO concerned as per section 19 of the RTI Act, 2005. Since the first appeal has not been exhausted by the appellant this should first be done. In the event of an unsatisfactory reply from the first appellate authority the appellant may prefer an appeal to the Commission as per the section 19 of the RTI Act, 2005.
